Terms & Conditions

Nivalion Legal Finance Summit 2022

These terms and conditions apply to and exclusively govern the Nivalion Legal Finance Summit on 6/7 September 2022 (the “Event”). Any terms and conditions used by participants shall not apply.

1.     Participants
The Event is exclusively open to participants who take part in a professional capacity. By registering for the Event, participants declare that they are not registering for the Event as consumers (Verbraucher) within the meaning of Sec. 13 of the German Civil Code.

2.     Registration
Registration for the Event can be made exclusively through the Event website www.nivalionsummit.com.

Registration is legally binding and non-transferable.

The number of participants is limited. Registrations will be processed, accepted and confirmed in the order that they are made.

A legally binding contract entitling to participation only comes into existence once the registration fee has been paid and the registration has been confirmed.

3.     Registration Fee
The registration fee is to be paid exclusively in the manner described on the Event website www.nivalionsummit.com.

The fact that a participant chooses to attend only parts of the Event does not entitle to a reduction of the registration fee.

4.     Rescission by Participant
Participants may rescind their registration up until 9 August 2022 with full reimbursement of their admission fee. Thereafter, participants will receive no reimbursement.

The rescission is to be declared via email to summit@nivalion.com. It will not be accepted via any other channels.

5.     Right to Modification
Nivalion retains the right to make necessary and reasonable changes to the Event, including its contents and administration, before and/or during the Event, to the extent that such changes do not fundamentally alter the character of the Event and the benefit participants may derive from it. Such changes include, but are not limited to, the replacement of individual speakers in case of illness or other reasons that could not reasonably be foreseen by Nivalion.

6.     Postponement or Cancellation
Nivalion reserves the right to postpone or cancel the Event for good cause (aus wichtigem Grunde), for which Nivalion is not responsible. Good cause in the aforementioned sense includes, but is not limited to

  • registration of an insufficient number of participants that would make the Event economically unviable;
  • cancellation/non-participation of a significant number of speakers;
  • technical issues that would make the Event economically unviable;
  • any applicable governmental restrictions or prohibitions (whether by law, court decision or administrative act) on in-person events and the permissible number of participants due to COVID-19 or other pandemic diseases.

In the event of cancellation, participants will be informed promptly via email. Any payments already made will be reimbursed in the same way the payment of the registration fee was made.

All further claims that might arise in connection with the postponement or cancellation of the Event are excluded. In particular, Nivalion accepts no liability for the costs of any travel and accommodation arrangements made by participants. Damages claims based on death or injury and/or in cases of gross negligence (grobe Fahrlässigkeit) or wilful action (Vorsatz) on Nivalion’s part shall not be excluded.

7.     Privacy Protection
By registering for the Event, participants consent to the following: During the Event, photos will be taken and audio and/or video recordings will be made by professional photographers hired by Nivalion.

Any photos or video recordings made in connection with the event can be used by Nivalion without paying compensation to participants and without temporal or spatial limitations of the use. Such use may include publication in print and online media, as well as professional social media channels.

Consent can be withdrawn at any time via e-mail to summit@nivalion.com.

8.     Exclusion of Liability
Without prejudice to any other limitations or exclusions of liability contained in these terms and conditions, any liability of Nivalion is excluded, except for cases of death or injury and/or gross negligence (grobe Fahrlässigkeit) or wilful action (Vorsatz) on Nivalion’s part

9.     Choice of Law and Dispute Resolution
These terms and conditions are governed by German law without recourse to its conflict of laws provisions. Place of performance (Erfüllungsort) within terms of Sec. 269 of the German Civil Code is Frankfurt/Main. All disputes arising out of, or in connection with, the Event are to be settled by the Frankfurt/Main courts.

10.  Final Provisions
There are no additional agreements governing the Event besides these terms and conditions. Any changes to these terms and conditions have to be made in writing. This includes the derogation from the written form requirement.

11.  Severability
Should any provision of these terms and conditions be, or become, invalid, this shall not affect the validity of the other provisions contained herein. The invalid provision shall be substituted by a valid one which as closely as possible achieves the economic purpose of the invalid clause.
